第一章 总 则
第一条 为建立健全城镇职工基本医疗保险制度,保障职工基本医疗,提高职工健康水平,促进社会主义市场经济发展,根据《中华人民共和国劳动法》、《社会保险费征缴暂行条例》和《国务院关于建立城镇职工基本医疗保险制度的决定》,结合本市实际,制定本规定。
第二条 本规定适用于厦门市辖区内的下列用人单位及其职工。
㈠ 国家机关及其工作人员、事业单位及其职工;
㈡ 国有企业、城镇集体企业、外商投资企业、城镇私营企业和其他城镇企业及其职工;
㈢ 社会团体及其专职人员、民办非企业单位及其职工;
㈣ 境外企业驻厦代表机构及其中方职工;
㈤ 依据本规定参加基本医疗保险的用人单位中符合国家规定的退休人员。
办理了《暂住证》和《厦门市外来人员就业证》的外来从业人员,其社会医疗保险办法另行制定。
离休人员、老红军的医疗保障按本市有关规定执行,二等乙级以上革命伤残军人的医疗保障办法另行制定。
第三条 城镇个体劳动者可自愿参加基本医疗保险,具体办法按本市有关规定执行。
第四条 职工基本医疗保险坚持基本医疗保险的水平与本市生产力发展水平相适应的原则;坚持城镇所有用人单位及其职工都参加基本医疗保险,实行属地管理的原则;坚持基本医疗保险费由用人单位和职工双方共同负担的原则;坚持基本医疗保险实行社会统筹和个人帐户相结合的原
则。
第五条 市劳动保障行政部门负责本规定的组织实施。社会保险经办机构具体承办基本医疗保险业务,负责基本医疗保险基金的征缴、管理和支付。
第二章 基本医疗保险费的征缴
第六条 基本医疗保险费由用人单位和职工共同缴纳。
用人单位以在职职工上年度工资总额作为基数,按8%的比例缴纳;在职职工以本人上年度工资总额作为基数,按2%的比例缴纳,由用人单位从其工资中代扣代缴。
基本医疗保险费不得减免。
第七条 职工个人工资总额超过上年度全市职工平均工资300%以上的,以300%作为缴费基数,低于60%的,以60%作为缴费基数。
本年度参加工作或调入本市工作的职工,按本人实领月工资推算得出缴费基数;工资总额不明确的,以上年度全市职工平均工资作为缴费基数。
第八条 1998年7月1日以前退休的人员参加基本医疗保险,个人不再缴纳基本医疗保险费。
1998年7月1日以后退休的参保职工,退休时缴纳基本医疗保险费的年限男满30年、女满25年的,不再缴纳基本医疗保险费;不足年限的,须由用人单位和职工分别按照用人单位和职工个人的缴费比例一次性缴足基本医疗保险费,方可享受退休人员基本医疗保险待遇。
1998年7月1日以前符合国家规定的连续工龄或工作年限视同缴费年限。
第九条 国有企业下岗职工在领取基本生活保障费期间,由再就业服务中心以上年度全市职工平均工资的60%作为基数,按用人单位与职工个人的缴费比例之和缴纳基本医疗保险费。
第十条 企事业单位因破产、撤销、解散或者其它原因终止的,须为其终止时在册的在职职工,以上年度全市职工平均工资作为基数,按用人单位与职工个人的缴费比例之和一次性清缴两年的基本医疗保险费。
依照上款规定清缴基本医疗保险费的企事业单位,其退休人员纳入全市职工基本医疗保险统一管理,在职职工享受两年的基本医疗保险待遇。
第十一条 失业人员可继续参加基本医疗保险,由社会保险经办机构委托社会化管理机构统一办理。在领取失业救济金期间,由个人以上年度全市职工平均工资的60%作为缴费基数,按用人单位与职工个人缴费比例之和缴纳基本医疗保险费;领取失业救济金期满后尚未就业的,以上
年度全市职工平均工资作为基数缴纳基本医疗保险费。
第十二条 用人单位缴纳的基本医疗保险费依现行财政体制和现有资金渠道按下列规定列支∶
㈠ 机关、事业单位,在单位的“社会保障费”中列支;
㈡ 企业缴纳的基本医疗保险费按一定比例在“职工福利费”和“劳动保险费”中列支。
第十三条 用人单位缴纳基本医疗保险费确有困难的,应提前1个月向市劳动保障行政部门提出申请,经批准可以缓缴,缓缴期最长为3个月,缓缴期内免收滞纳金,期满后补缴基本医疗保险费,并按城乡居民活期存款利率缴纳利息。
第十四条 用人单位取得营业执照或获准设立之日起30日内,必须办理基本医疗保险登记;用人单位录用人员之日起30日内必须办理基本医疗保险。
第十五条 用人单位名称、住所、单位类型、法定代表人或负责人、开户银行帐号等登记事项发生变更或用人单位依法终止的,应自变更或者终止之日起30日内向社会保险经办机构办理变更或者注销登记手续。
用人单位发生人员辞退、退休、死亡等变动的,应自变动之日起30日内向社会保险经办机构办理变更手续,并重新核定基本医疗保险费的应缴数额。
第十六条 用人单位应按照社会保险经办机构的统一安排申报上年度缴费工资、养老金或退休金总额,经社会保险经办机构核定后,于每年7月1日执行。
第十七条 开元区、思明区、湖里区、鼓浪屿区范围内的用人单位向市社会保险经办机构办理基本医疗保险手续;杏林区(含海沧)、集美区和同安区范围内的用人单位向所在辖区的社会保险经办机构办理基本医疗保险手续。
第十八条 基本医疗保险费的收缴由社会保险经办机构委托银行代办,用人单位须于每月15日前将本月单位应缴纳部分和职工个人应缴纳部分一并缴纳。
第十九条 用人单位不按规定缴纳基本医疗保险费,社会保险经办机构从次月起暂停该单位参保人员享受社会统筹医疗基金支付医疗费用的待遇,暂停期间所发生的医疗费用,由用人单位负担。
第三章 社会统筹医疗基金和个人医疗帐户
第二十条 用人单位和职工缴纳的基本医疗保险费形成基本医疗保险基金,基本医疗保险基金划为社会统筹医疗基金和个人医疗帐户。
第二十一条 个人医疗帐户按下列规定于每年7月1日由社会保险经办机构一次性划入全年额度:
㈠ 职工个人缴纳的基本医疗保险费,全部划入职工个人医疗帐户;
㈡ 用人单位为职工个人缴纳的基本医疗保险费,按年龄段划入个人医疗帐户:35岁以下的按单位为个人全年缴费的20%划入;36岁至49岁的,按30%划入;50岁以上的,按40%划入;
退休人员按本人上年度养老金或退休金总额的8%划入个人医疗帐户。
第二十二条 用人单位和职工个人缴纳的基本医疗保险费按第二十一条规定的比例划入个人医疗帐户后,其余的部分进入社会统筹医疗基金。
按本规定收取的滞纳金以及其它收入纳入社会统筹医疗基金。
第二十三条 社会保险经办机构为每一参保人员建立个人医疗帐户,设立医疗保险号码,制发医疗保险IC卡。医疗保险IC卡是参保人员就医、购药和结算医疗费用的专用凭证。
第二十四条 个人医疗帐户的本金和利息归参保人员所有,专用于本人的医疗支出,可以结转下年度使用、转移和继承,但不得提取现金或挪作他用。
第二十五条 参保人员调离本市的,应按规定办理个人医疗帐户转移和医疗保险IC卡注销手续,其个人医疗帐户结余资金随同转移,无法转移的,经社会保险经办机构核准,可一次性支付给本人。
从外地调入本市的人员,应办理医疗保险手续并转入其个人医疗帐户资金。
第二十六条 参保人员死亡时,其个人医疗帐户和医疗保险IC卡注销,个人医疗帐户结余资金划入合法继承人的个人医疗帐户;继承人未参加基本医疗保险的,个人医疗帐户结余资金可一次性支付给继承人;没有合法继承人的,个人医疗帐户结余资金划入社会统筹医疗基金。
第四章 基本医疗保险待遇
第二十七条 依照本规定参加基本医疗保险的人员,享受本规定的基本医疗保险待遇。
第二十八条 每年7月1日至次年6月30日为职工基本医疗费用计算年度。在年度内参保人员发生的医疗费用,先从个人医疗帐户支付。个人医疗帐户金额3000元以下的,用完为止;超过3000元的,用到3000元为止,然后由个人现金自付。按年度计算,自付金额在职职
工为上年度全市职工平均工资的8%,退休人员为3%。个人医疗帐户金额超过3000元以上的部分,可用于抵付个人现金自付部分的医疗费用。个人现金自付后的医疗费用,由社会统筹医疗基金支付,但个人仍要负担一定的比例:
㈠ 医疗费用在5000元以下的部分,在职职工个人负担15%,退休人员个人负担7.5%;
㈡ 医疗费用在5000元以上10000元以下的部分,在职职工个人负担8%,退休人员个人负担4%;
㈢ 医疗费用在10000元以上的部分,在职职工个人负担5%,退休人员个人负担2.5%。
第二十九条 在一个职工基本医疗费用计算年度内,每一参保人员由社会统筹医疗基金支付的医疗费用最高限额为上年度全市职工平均工资的4倍左右,具体数额每年由市人民政府公布。超过最高限额的医疗费用,按本市有关规定执行。
第三十条 异地工作人员、长期居住外地的退休人员应在所在地定点医疗机构就医,所发生的医疗费用持有效凭证到社会保险经办机构审核结算。
出差人员在出差期间患急性病时应就近就医,所发生的医疗费用持有效凭证到社会保险经办机构审核结算。
第三十一条 参保人员患有国家认定的特殊病种、实施计划生育手术及经鉴定为手术后遗症、见义勇为负伤所需的医疗费,由社会统筹医疗基金全额支付。
第三十二条 参保人员确因病情需要转移到市外就医的,须由定点医疗机构中的三级医院或专科医院签署转院建议书,经本人申请,社会保险经办机构批准后,方可转诊。因病情危急,来不及办理手续的,须于就医之日起7日内补办。
转外就医所发生的医疗费用,于治疗终结后,持有效凭证到社会保险经办机构审核结算,其医疗费用先由个人负担10%后,再按第二十八条的规定支付。
第三十三条 参保人员发生的医疗费用按照本市职工基本医疗保险基金支付范围、基本医疗保险用药目录、基本医疗保险服务项目的有关规定执行。
第五章 基本医疗保险服务与管理
第三十四条 基本医疗保险实行定点医疗机构和定点药店管理。参保人员凭本人医疗保险IC卡自主选择定点医疗机构就医,并可凭定点医疗机构开具的处方到定点药店购药。
第三十五条 本市辖区内依法开业的医疗机构和药店,均可向市劳动保障行政部门申请承办基本医疗保险服务业务,经审查批准,颁发定点医疗机构和定点药店资格证书。社会保险经办机构要根据中西医并举,基层、专科和综合医疗机构兼顾,方便职工就医的原则,负责确定定点医疗
机构和定点药店。定点医疗机构和定点药店资格实行年检制度。
第三十六条 社会保险经办机构与定点医疗机构、定点药店应签订基本医疗保险服务合同,明确双方的责任、权利和义务。
第三十七条 定点医疗机构和定点药店应加强医务人员和服务人员的业务技术培训和职业道德教育,制定和完善必要的制度,提供优质服务,保证医疗和药品质量,坚持因病施治,科学用药,合理检查,有效治疗,并将所开药品及所作的各类检查、治疗在规定的凭证上记录,接受市劳
动保障行政部门和有关部门的检查和监督。
第三十八条 定点医疗机构应执行国家、省、市卫生行政部门制定的诊疗技术规范。定点医疗机构必须执行国家、省、市物价等行政部门制定的医疗服务项目的收费标准。
第三十九条 定点医疗机构和定点药店必须配置医疗保险电脑管理系统终端,同社会保险经办机构联网运行。
第四十条 定点医疗机构及其工作人员在提供基本医疗服务过程中,不得有下列行为:
㈠ 将非定点医疗机构的医疗费用、非基本医疗保险基金支付范围的医疗费用列入基本医疗保险基金支付和不按规定结算医疗费用;
㈡ 不核验医疗保险IC卡,将非参保对象的医疗费用纳入基本医疗保险基金支付;
㈢ 拒绝收治本医疗机构收治范围内的病人,或拒绝使用医疗保险IC卡结算医疗费用;
㈣ 不坚持因病施治,故意限制门诊处方金额以及住院费用;
㈤ 采取分解门诊人次或住院人次,套取基本医疗保险基金;
㈥ 不执行规定的医疗服务收费标准和药品价格,以及违反价格管理有关规定收费造成基本医疗保险基金损失。
第四十一条 定点药店及其工作人员在提供基本医疗服务过程中,不得有下列行为:
㈠ 不按处方剂量配药;
㈡ 将处方用药换成本市职工基本医疗保险用药目录以外的药品或其他物品;
㈢ 不执行规定的药品价格以及违反药品价格管理有关规定收费造成基本医疗保险基金损失。
第四十二条 参保人员在就医、购药和结算医疗费用过程中,不得有下列行为∶
㈠ 将本人的医疗保险IC卡转借他人就医和购药;
㈡ 冒用他人的医疗保险IC卡就医和购药;
㈢ 伪造、涂改处方、医疗费用单据等凭证,虚报冒领医疗费。
第六章 基本医疗保险基金管理和监督
第四十三条 基本医疗保险基金实行统一征缴、统一管理和统一支付。基本医疗保险基金坚持以收定支、收支平衡的原则,社会统筹医疗基金和个人医疗帐户分开核算、各自平衡。
第四十四条 基本医疗保险基金实行财政专户管理、专款专用,不得挤占、挪用。市财政部门、劳动保障行政部门负责对基本医疗保险基金的管理和监督。审计部门负责对社会保险经办机构的基本医疗保险基金收支情况和管理情况进行审计。
第四十五条 社会保险经办机构与定点医疗机构实行医疗费用平均定额结算为主、其他结算方式作为补充的结算办法,井按月结算医疗费用。具体办法由市劳动保障行政部门会同市财政、卫生部门制订。
第四十六条 社会保险经办机构按月向定点药店结算药品费用。定点药店应于每月5日前将上月发生的基本医疗保险药品销售结算清单提交社会保险经办机构审核结算。
第四十七条 基本医疗保险基金不计征税费。
第四十八条 设立由人大代表、政协委员、市政府有关部门代表、用人单位代表。医疗机构代表、职工代表和有关专家组成的基本医疗保险基金监督组织,定期检查基本医疗保险基金的收支管理情况。
第四十九条 社会保险经办机构应建立健全基本医疗保险基金预决算审批制度、财务会计制度和内部审计制度。社会保险经办机构应在规定的时间内向市财政部门和市劳动保障行政部门报送基本医疗保险基金财务报表。
社会保险经办机构的经费由同级财政全额拨付。
第五十条 用人单位和职工有权向社会保险经办机构查询职工基本医疗保险费的缴交及个人医疗帐户资金收支情况。
社会保险经办机构在每一职工基本医疗费用计算年度开始后,应向参保单位发送载有每一参保人员缴费和个人医疗帐户情况的清册。
第五十一条 劳动保障行政部门有权稽核用人单位的有关帐目、报表,核实参保人员、缴费工资基数和养老金或退休金。社会保险经办机构受劳动保障行政部门的委托,可进行与职工基本医疗保险业务有关事项的检查、调查工作。
第五十二条 用人单位应主动配合社会保险经办机构做好基本医疗保险的管理工作,指定专、兼职人员做好本单位的基本医疗保险管理业务,并定期向职工公布年度工资总额和基本医疗保险费的缴交情况,接受职工的监督。
用人单位对患病职工应给予关心照顾,对低收入家庭和生活困难的职工因医疗费用负担过多影响基本生活时,应给予适当补助。
第五十三条 用人单位在办理基本医疗保险业务过程中,不得有下列行为:
㈠ 将不属于基本医疗保险的人员列入基本医疗保险范围;
㈡ 少报工资总额、多报养老金或退休金;
㈢ 将患有疾病、不符合招工条件的人员临时招聘到单位工作,为其办理基本医疗保险;
㈣ 向社会保险经办机构提供虚假凭证,造成基本医疗保险基金损失。
第五十四条 市劳动保障行政部门可根据社会经济发展及职工基本医疗保险基金的收支情况,对基本医疗保险费的征缴比例、个人医疗帐户划入比例、基本医疗保险待遇标准等提出调整意见,经市人民政府批准后实施。
第七章 罚 则
第五十五条 用人单位未按本规定办理基本医疗保险登记、变更、注销手续,或者未按规定申报应缴纳的基本医疗保险费数额的,责令限期改正,按照《社会保险费征缴暂行条例》处罚。
第五十六条 拒缴、拖欠或少缴等迟延缴纳基本医疗保险费的,由劳动保障行政部门向用人单位发出缴费通知书,用人单位在通知书送达之日起15日内必须缴清基本医疗保险费;逾期仍不缴纳的,从欠缴之日起按日加收欠缴额2‰的滞纳金,并对直接负责的主管人员和其他责任人员
按照《社会保险费征缴暂行条例》处罚。
第五十七条 定点医疗机构及其工作人员有本规定第四十条规定情形之一,造成基本医疗保险基金损失的,追回经济损失;情节严重的,取消定点医疗机构资格。
定点医疗机构及其工作人员有本规定第四十条第一项至第五项情形之一,对单位可处以5000元以上20000元以下的罚款,对直接负责的主管人员和其他直接责任人可处以500元以上1000元以下的罚款。
第五十八条 定点药店及其工作人员有本规定第四十一条规定情形之一,造成基本医疗保险基金损失的,追回经济损失;情节严重的,取消定点药店资格。
定点药店及其工作人员有本规定第四十一条第二项情形的,对单位可处以5000元以上20000元以下的罚款,对直接负责的主管人员和其他直接责任人可处以500元以上1000元以下的罚款。
第五十九条 参保人员有本规定第四十二条规定情形之一,暂停其基本医疗保险待遇2个月以上6个月以下;造成基本医疗保险基金损失的,追回经济损失,并可处以500元以上1000元以下的罚款。
第六十条 用人单位有本规定第五十三条规定情形之一,造成基本医疗保险基金损失的,追回经济损失。
用人单位有本规定第五十三条第一、三、四项情形之一,对单位可处以5000元以上20000元以下的罚款,对直接负责的主管人员和其他直接责任人可处以500元以上1000元以下的罚款。
第六十一条 在基本医疗服务过程中,定点医疗机构和定点药店工作人员与参保人员相互串通,利用医疗保险IC卡套取本市职工基本医疗保险用药目录以外的药品或其它物品,以及利用医疗保险IC卡获取本市基本医疗保险支付范围以外的医疗服务项目的,追回经济损失,对定点医疗机
构和定点药店工作人员及参保人员可分别处以500元以上1000元以下的罚款。
第六十二条 社会保险经办机构及其工作人员在征缴基本医疗保险费及审核医疗费用时,殉私舞弊,损公肥私,或利用职权和工作之便索贿受贿,谋取私利,以及工作失职造成基本医疗保险基金损失的,追回经济损失,对直接负责的主管人员及其它直接责任人给予行政处分,并可处以
500元以上1000元以下的罚款。
第六十三条 违反本规定,构成犯罪的,依法追究刑事责任。
第六十四条 本规定的行政处罚,由市劳动保障行政部门作出。
第六十五条 有本规定第四十条第六项、第四十一条第一项、第三项、第五十三条第二项情形的,由有关部门按有关规定处罚。
第六十六条 当事人对行政处罚不服的,可依法申请行政复议或提起行政诉讼。逾期不申请行政复议,也不提起行政诉讼,又不执行处罚决定的,市劳动保障行政部门向人民法院申请强制执行。
第八章 附 则
第六十七条 用人单位、参保人员、定点医疗机构、定点药店、社会保险经办机构之间发生有关基本医疗保险争议时,由争议方协商解决;协商不成的,可提请市劳动保障行政部门裁决。
第六十八条 本规定所称工资总额按国家统计局的规定执行。
第六十九条 本规定所称的职工不含用人单位聘用的港、澳、台员工及外籍员工。
第七十条 本规定自1999年7月1日起施行。本市有关规定与本规定不一致的,以本规定为准。

Ordinance may be cited as the Securities (Insider Dealing)
Ordinance.
nterpretation
In this Ordinance, unless the context otherwise requires--

A person is connected with a corporation for the purposes of

he occupies a position which may reasonably be expected to give

ss to relevant information concerning the corporation by virtue
of--
any professional or business relationship existing between
himself (or
employer or a corporation of which he is a director or a firm of

his being a director, employee or partner of a
